The Breeder assumes no responsibility for training difficulties or behavioral issues. The Buyer is responsible for providing proper care, training, and environment for the puppy. No warranty is provided regarding the puppy’s suitability for any specific purpose.

The Buyer acknowledges that outcomes related to behavior, temperament, and performance are influenced by environment, training, and handling after the puppy leaves the Breeders care.

SECTION 7 - VETERINARY DIAGNOSIS

Veterinarians may have differing medical opinions. For this reason, the Breeder reserves the right to request a second opinion from a licensed veterinarian of the Breeder’s choosing to confirm any diagnosis provided by the Buyer’s veterinarian. SECTION 9- FULFILLMENT OF HEALTH GUARANTEE

This health guarantee applies only to the original Buyer listed in this contract and is non-transferable. The guarantee is limited to a replacement puppy of equal value, provided one is available. The value of the replacement puppy will be determined by the Breeder. The returned puppy must not be abused, neglected, or intentionally harmed in any way by the Buyer. All transportation and shipping costs associated with returning the original puppy and receiving a replacement puppy are the responsibility of the Buyer. At the Breeder’s discretion, return shipping costs may be reimbursed if the condition is determined to be 100% hereditary, genetic, and life-threatening, and the Buyer has been fully transparent with all veterinary records and care history.

The Buyer agrees not to tether or confine the puppy for extended periods in a manner that compromises its well-being.

Under no circumstances is the puppy to be surrendered, sold, rehomed, abandoned, or transferred to any shelter, rescue, humane society, or third party without the Breeder’s prior written consent. If at any time the Buyer is unable or unwilling to keep the puppy, the Buyer agrees to immediately contact the Breeder. The puppy must be returned to the Breeder, unless alternate arrangements are approved in writing by the Breeder.

This policy is mandatory and is in place to ensure the lifelong safety and well-being of the puppy. Failure to comply with this section is a breach of contract and may result in legal action. Return terms, including any applicable refund or credit, are outlined in Section 20 of this agreement.

SECTION 11 - REGISTRATION (AKC / ASDR)

All puppies sold by JKKJ Farms, LLC will be provided with AKC and ASDR registration paperwork if applicable.

"FULL Breeding Rights" vs "Limited Rights defined as: Limited Rights = Pet/Companion ONLY. Full Rights = Breeding Rights.

Puppies sold without breeding rights are placed on a Limited Registration Agreement. These puppies are sold strictly as companions and are not to be bred under any circumstances. While the Breeder recommends spay/neuter around 24 months of age, the enforcement of this agreement is based on breeding activity, not timing of alteration.

If a puppy sold on limited registration is bred—whether intentionally or accidentally—the Buyer will be in breach of contract. This provision applies for the lifetime of the dog. Any litter produced in violation of this agreement must be disclosed to the breeder upon request.

In such case, the Buyer agrees to the following: A $10,000 Breeding Violation Fee. No additional registration privileges or breeding rights will be granted. The Buyer agrees to assume all veterinary costs and any other expenses incurred in connection with the care of the puppy after it leaves the Breeder possession. The Buyer waives claim for reimbursement against the Breeder for such expenses. Full payment is due three (3) days prior pick up or before the puppy is released to transport personnel unless other arrangements have been made between Breeder and Buyer.

SECTION 13 - NO GUARANTEE ON SIZE

The Breeder makes no guarantee regarding the puppy's adult size, weight, growth. Any estimates provided are based on parental lineage and past litters and are not guaranteed. No refunds, returns, or compensation will be provided based on the puppy maturing to a size larger or smaller than expected.

SECTION 14 - FAILURE TO PAY / FAILURE TO PICKUP / BOARDING FEE REQUIREMENTS

The Buyer agrees that the puppy’s remaining purchase balance is due in full no later than the date the puppy reaches eight (8) weeks of age, regardless of the scheduled pickup date.

If the Buyer anticipates that the puppy will remain with JKKJ Farms beyond nine (9) weeks of age, any anticipated boarding/holding fees must also be paid in advance no later than the puppy’s eight (8) week birthday. The puppy purchase price and any applicable prepaid boarding/holding fees are separate charges and must both be paid by the required deadline.

JKKJ Farms allows a pickup grace period through the puppy’s ninth (9th) week of age. No boarding fee will be charged during this grace period.

Beginning the day after the puppy reaches nine (9) weeks of age, a boarding/holding fee of $25 per day will apply for any approved extended stay.

If the puppy’s purchase balance and any required prepaid boarding/holding fees are not paid in full by eight (8) weeks of age, JKKJ Farms reserves the right to cancel the reservation, terminate the Purchase Agreement, retain any non-refundable deposits or fees in accordance with this Agreement, and immediately relist the puppy.

Any additional expenses incurred during the extended stay, including vaccinations, parasite prevention, veterinary care, medications, health certificates, or other agreed services, are the responsibility of the Buyer.

The Breeder agrees to the same standard and will not make false, misleading, or defamatory public statements about the Buyer. This clause does not apply to: Truthful statements, good faith reviews, communications required for legal proceedings. Including, but not limited to, statements or evidence provided in court filings, depositions, or hearings.

SECTION 16 - FINANCIAL RESPONSIBILITY FOR HEALTH CAR

The Breeder strongly recommends that the Buyer activate the health insurance provided with the puppy at the time of pickup or delivery. Veterinary care can be costly, particularly for diagnosis and treatment of illness or injury. Puppies have developing immune systems and may be more susceptible to common illnesses during early life. If the Buyer seeks veterinary evaluation or testing in connection with a health guarantee claim, pet insurance may help offset associated costs. The Buyer acknowledges this recommendation and understands that any provided insurance coverage must be activated within 24 hours of the puppy leaving the Breeder’s care. All veterinary expenses remain the responsibility of the Buyer, unless otherwise stated in this agreement.

SECTION 17 - GOVERNING LAW, VENUE, AND DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. The remaining 50% is retained by the Breeder to cover costs associated with care, housing, advertising, and rehoming. If the puppy is returned after 30 days, no refund will be issued under any circumstances. Deposits are non-refundable, unless the puppy passes away while still in the care of the Breeder.

Financial Responsibility
