SECTION 1 – ADULT DOG DISCLOSURE
This Agreement applies to the sale and placement of an adult dog, not a puppy.
The Buyer acknowledges that adult dogs: May have established genetics, structure, and temperament that can continue to develop or change over time. They may have prior medical history, environmental influences, or previous ownership (if applicable), and they may not be a product of JKKJ Farms breeding program. JKKJ Farms, LLC agrees to disclose all known health, behavioral, and background information available at the time of sale.
SECTION 2 – CURRENT HEALTH CONDITION
At the time of transfer, the Breeder guarantees that the dog is in good general health to the best of their knowledge. Available records will be provided, including: Veterinary history (if available), vaccination records, and genetic testing (if applicable). This guarantee applies only to the dog’s condition at the time it leaves the Breeder’s care.
SECTION 3 – VETERINARY CHECK & RETURN OPTION
The Buyer agrees to have the dog examined by a licensed veterinarian within five (5) business days of receiving the dog. If a licensed veterinarian determines the dog has a serious or life-threatening condition present at the time of transfer, the Buyer must: Notify the Breeder immediately and provide written veterinary documentation.
If the Buyer chooses not to proceed with the dog, the dog may be returned under the refund terms outlined in Section 10. Failure to complete this examination within the required timeframe will void any health-related claims.
SECTION 4 – LIMITED HEALTH GUARANTEE (ADULT DOGS)
JKKJ Farms, LLC provides a limited health guarantee on adult dogs. This guarantee: Applies only to life-threatening conditions present at the time of transfer, and does not extend to future health outcomes. No guarantee is made regarding: Longevity, future illness or injury, and genetic expression over time.
SECTION 5 – EXCLUSIONS (NOT COVERED)
The following are not covered under any circumstance: Hip or elbow dysplasia, eye disorders or vision conditions, allergies or autoimmune conditions, dental or bite alignment issues, reproductive capability or fertility, and any condition developing after transfer. Conditions influenced by environment, care, nutrition, exercise, or lifestyle are not covered.
SECTION 6 – BREEDING QUALITY & GENETIC TESTING DISCLAIMER
No adult dog is guaranteed to be of breeding or show quality. Breeding Dogs (If Applicable). If the dog is sold with breeding rights, no guarantee is made regarding: Fertility, conception, Litter size, Semen quality, mothering ability, and past performance does not guarantee future results.
Genetic Testing Disclosure
JKKJ Farms, LLC guarantees the accuracy of completed and documented genetic testing only.
The Buyer acknowledges: Only testing that has been completed and provided is guaranteed. Any testing not yet completed (including OFA, PennHIP, or structural evaluations) is not guaranteed. The Breeder makes no guarantee the dog will: Pass future testing, meet breeding standards, qualify for any registry or program. The Buyer assumes full responsibility for any future testing and outcomes.
SECTION 7 – GENERAL NON-GUARANTEES & BUYER RESPONSIBILITY
No guarantee is made regarding: Temperament, behavior, trainability, compatibility with people, animals, or environment, performance or working ability. The Buyer assumes full responsibility for: Training, care, and physical environment.
SECTION 8 – TRANSITION & ADJUSTMENT (3-3-3 GUIDELINE)
The Buyer acknowledges that adult dogs require time to adjust and adjustment timelines vary.
First 3 Days: overwhelmed, anxious, withdrawn
First 3 Weeks: settling, routine forming, personality emerging
First 3 Months: bonding, trust building, stability
***Adjustment challenges are not grounds for return, refund, replacement, or dispute.
SECTION 9 – RETURN POLICY (RIGHT OF FIRST REFUSAL)
If the Buyer cannot keep the dog, it must be returned to JKKJ Farms, LLC at the Buyer expense this includes transportation fees. The dog must be returned with all paperwork including registration papers. The dog may not be: Rehomed, given away, surrendered to shelter or rescue without written approval from the Breeder.
SECTION 10 – RETURN & REFUND POLICY (ADULT DOGS)
JKKJ Farms, LLC does not offer replacement dogs under any circumstance for adult dogs. If the Buyer returns the dog:
- Within fourteen (14) business days: A full refund (excluding deposit) will be issued after return in good condition.
- After fourteen (14) business days: A 50% refund (excluding deposit) may be issued only after the dog is returned and rehomed.
- After thirty (30) days: No refund will be issued.
Deposit Policy: All deposits are non-refundable under any circumstance, including: Change of mind, personal circumstances, and return of the dog. The only exception is if the dog passes while in the Breeder’s care prior to transfer.
SECTION 11 – FINANCIAL RESPONSIBILITY
The Buyer assumes all costs after transfer, including: Veterinary care, transportation, maintenance, and no reimbursement will be provided.
SECTION 12 – LIABILITY WAIVER
The Buyer assumes full responsibility once the dog leaves the Breeder’s care. JKKJ Farms, LLC is not liable for: Injury or illness, death, and damages caused by the dog.
SECTION 13 – GOVERNING LAW
This Agreement is governed by Texas law. All legal action must take place in Angelina County, Texas.The prevailing party may recover attorney’s fees and court costs.
SECTION 14 – AGREEMENT TO TERMS
This Agreement represents the entire understanding between the parties. By signing, the Buyer confirms: They have read and understand all terms, they accept full responsibility for the dog, no guarantees exist beyond what is written.
